Welcome to FairyMail! These Terms of Service (“Terms”) govern your access to and use of our email marketing platform, website, dashboard, and related services (collectively, the “Services”). By accessing or using FairyMail, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately discontinue use of the Services.
1. Eligibility & Account Registration
To use our Services, you must:
- Be at least 18 years of age (or the age of legal majority in your jurisdiction), or have valid legal authorization from a parent or legal guardian.
- Provide accurate, complete, and current registration information.
- Maintain the confidentiality of your login credentials and accept responsibility for all activity under your account.
You agree to notify us immediately at [email protected] if you suspect unauthorized access or use of your account. FairyMail is not liable for any loss or damage arising from your failure to safeguard your account credentials.
2. Acceptable Use & Restrictions Registration
You agree to use the Services only in compliance with these Terms and all applicable laws and regulations. You may not use the Services to:
- Send unsolicited, deceptive, or unlawful bulk email communications (“spam”).
Upload, transmit, or distribute malware, viruses, phishing content, or any harmful or malicious code. - Collect, store, process, or share personal data without obtaining all necessary lawful consents and permissions.
- Engage in fraudulent, misleading, deceptive, or illegal activities.
- Infringe upon the intellectual property or other rights of any third party.
- Interfere with, disrupt, or compromise the integrity, security, or performance of the Services or related systems.
You are solely responsible for the content you create, upload, or distribute through the Services and for ensuring that your email campaigns comply with all applicable anti-spam, privacy, and data protection laws.
FairyMail reserves the right, at its sole discretion, to suspend, restrict, or terminate any account immediately and without prior notice for violations of these Terms, applicable laws, or our Anti-Spam Policy.
3. Subscription Plans, Billing & Payments
3.1 Subscription Plans
FairyMail offers free and paid subscription plans, which may include limitations on features, sending volumes, contact limits, or other functionality depending on the selected plan.
If you activated an Early Adopter Plan under the FairyMail Early Access Program, your subscription is additionally governed by the applicable Early Access Policy.
We reserve the right to modify, limit, or discontinue plan features at our discretion, subject to Section 3.3 below regarding pricing protections for active annual plans.
3.2 Billing & Renewals
Paid subscriptions are billed at the beginning of each billing cycle (monthly or annually, as selected at checkout).
Subscriptions automatically renew at the end of each billing period unless canceled prior to the renewal date through your account settings.
If a payment cannot be processed, FairyMail may suspend, restrict, or downgrade your account until payment is successfully completed.
If a user does not renew a paid plan, the account may automatically transition to the Free Plan, subject to the limitations and restrictions applicable to that plan. Features, sending limits, and functionality will adjust according to the applicable plan level.
If a user upgrades to a higher-tier plan during an active billing period, the user agrees to pay the prorated price difference between the current plan and the upgraded plan. The prorated amount is calculated based on the remaining time in the current billing cycle.
3.3 Payments
All paid plans require payment of the applicable subscription fee as displayed on the FairyMail website or in an official offer at the time of purchase. Fees must be paid in full in advance prior to activation of a paid plan.
Annual plans are valid for one (1) year from the date payment is successfully processed (the “Activation Date”). At the end of the one-year term, the subscription will renew automatically unless canceled prior to renewal in accordance with Section 3.2.
All fees are exclusive of applicable taxes. Any required taxes will be calculated based on the user’s billing information and added at checkout, where required by law.
Payments must be made in the currency specified at checkout. Any currency conversion charges, bank fees, or transaction costs are the responsibility of the user.
FairyMail reserves the right to modify pricing, subscription structures, or plan offerings at any time for new customers. Such changes will not affect users who have already activated and paid for a current annual plan during its active term.
Payments are securely processed through authorized third-party payment providers. By completing a purchase, you agree to comply with the applicable terms and policies of such payment processors in addition to these Terms.
3.4 Payments
You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing cycle.
Unless otherwise required by applicable law, all payments are non-refundable, and no partial refunds or credits will be issued for unused time, unused sending volume, or unused features.
4. Termination & Account Suspension
FairyMail reserves the right, at its sole discretion, to suspend, restrict, or terminate your access to the Services if:
- You violate these Terms, our Privacy Policy, or Anti-Spam Policy.
- You fail to pay applicable subscription fees when due.
- Your use of the Services poses a security risk, legal risk, or reputational risk to FairyMail.
- We are required to do so by applicable law, regulation, or governmental authority.
Upon suspension or termination, your account may be deactivated and access to stored data may be limited or permanently revoked. We strongly recommend exporting and backing up your data prior to cancellation or anticipated termination.
FairyMail reserves the right to terminate accounts that remain inactive for an extended period. An account may be considered inactive if, for example:
- DKIM verification has not been completed within three (3) months of registration; or
- The subscriber list remains at zero (0) for six (6) consecutive months.
We may provide notice prior to termination of inactive accounts, but we are not obligated to do so.
4.1 Termination by the User
Upon termination, suspension, expiration, or downgrade of a paid plan:
- Your right to access and use paid features of the Services will immediately cease.
Your account may be downgraded to a Free Plan, where applicable. - FairyMail may, but is not obligated to, retain account data for a limited period in accordance with its Privacy Policy and applicable legal obligations.
- After any applicable retention period, data may be permanently deleted without further notice.
4.2 Effect of Termination
The user’s right to access and use the Service will immediately cease; FairyMail may, but is not obligated to, retain data and account information for a reasonable period in accordance with its Privacy Policy; and the user may be offered the option to migrate to another available FairyMail plan, subject to the features and fees of that plan.
4.3 Survival of Terms
Any provisions of these Terms which by their nature should survive termination, including but not limited to provisions relating to payment obligations, limitations of liability, indemnification, intellectual property, data protection, and dispute resolution, shall remain in full force and effect following termination.
5. Feedback and Communication
5.1 Voluntary Feedback
FairyMail encourages users to share feedback, suggestions, and ideas to help improve the Service. Providing feedback is voluntary and not a condition of participation in any paid plan.
5.2 Rights to Use Feedback
By submitting feedback, comments, bug reports, or suggestions, users grant FairyMail a perpetual, worldwide, royalty-free, and irrevocable license to use, reproduce, modify, and incorporate such feedback into the Service or related products without compensation or acknowledgment.
5.3 Communication Channels
Participants may communicate with FairyMail through designated channels such as support email, contact forms, or other communication tools provided by the company. FairyMail may also reach out to participants to request clarification, additional input, or participation in surveys.
5.4 Confidentiality of Discussions
Unless otherwise stated in writing by FairyMail, communications between FairyMail and participants regarding features or testing activities are considered confidential and should not be shared publicly, posted online, or disclosed to third parties.
6. Intellectual Property
FairyMail, including our software, logos, trademarks, and all related intellectual property, is owned by FairyMail or our licensors. You may not copy, modify, distribute, or create derivative works of our platform without our prior written consent.
7. Service Availability & Limitations of Liability
FairyMail strives to provide reliable, secure, and high-quality Services. However, the Services are provided on an “as is” and “as available” basis, and we do not guarantee:
- Uninterrupted or continuous access to the Services;
- Error-free, secure, or defect-free operation;
- That the Services will meet your specific business or performance expectations; or
- That any data will be completely secure or free from unauthorized access.
You acknowledge that temporary interruptions may occur due to maintenance, updates, third-party service failures, internet disruptions, force majeure events, or circumstances beyond our reasonable control.
To the fullest extent permitted by applicable law:
- FairyMail shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, business interruption, or loss of business opportunities, arising out of or related to your use of the Services.
- FairyMail’s total cumulative liability for any claim arising out of or relating to the Services shall not exceed the total amount paid by you for the Services during the twelve (12) months preceding the event giving rise to the claim.
Some jurisdictions do not allow certain limitations of liability. In such cases, liability will be limited to the maximum extent permitted by law.
8. Indemnification
You agree to indemnify, defend, and hold harmless FairyMail, its directors, officers, employees, affiliates, and service providers from and against any claims, damages, losses, liabilities, fines, penalties, costs, and expenses (including reasonable legal fees) arising out of or related to:
Your use of the Services;
- Your violation of these Terms, the Privacy Policy, Anti-Spam Policy, DPA, or any other applicable policy;
- Your violation of any applicable law or regulation, including data protection or anti-spam laws;
- Any content, email campaign, data, or materials you create, upload, send, or distribute through the Services; or
- Any claim that your content or activities infringe upon or violate the rights of a third party.
FairyMail reserves the right to assume exclusive control of the defense and settlement of any matter subject to indemnification, and you agree to cooperate fully in the defense of such claims.
9. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to conflict of law principles.
Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Services shall be subject to the exclusive jurisdiction of the competent courts of the United Arab Emirates.
10. Data Protection & Privacy
Your use of FairyMail is subject to our Privacy Policy, which explains how we collect, use, and store personal data. By using our Services, you consent to our data processing practices.
11. Changes to These Terms
We may update these Terms from time to time. Significant changes will be notified to you via email or a notice on our website. Your continued use of the Services after such updates constitutes acceptance of the revised Terms.
