Early Access Policy

Welcome to the FairyMail Early Access Program (“the Program”). This Early Access Policy outlines the terms and conditions that apply when users participate in the Program.
This Policy governs participation in the Early Access Program in addition to FairyMail’s Terms of Service and all other applicable legal documents. By accessing or using FairyMail during the Early Access period, you acknowledge that you have read, understood, and agree to be bound by this Policy. If you do not agree, please discontinue your participation in the Program immediately.
1. Eligibility and Access
1.1 Participation
Participation in the FairyMail Early Access Program is entirely voluntary and may be limited to users who register or are invited through FairyMail’s official channels or representatives. Access may be subject to availability, technical requirements, and verification of account information.
1.2 Selection and Availability
FairyMail reserves the right to determine eligibility for participation at its sole discretion. The Program may be offered to a limited number of users or within specific regions.
1.3 Withdrawal or Modification
FairyMail may suspend, modify, or terminate the Early Access Program, or any participant’s access to it, at any time and without prior notice. In such cases, FairyMail will make reasonable efforts to inform affected users, but is under no obligation to continue offering Early Access or any related benefits.
1.4 Continuation of Active Early Access Plans
If FairyMail discontinues or withdraws the Early Access Program while a user’s paid Early Access plan is still active, that user’s access will remain valid for one (1) year from the original activation date of the plan.
After this period expires, the plan will automatically end, and the user may choose to upgrade to any of FairyMail’s subscription plans available at that time.
If the user does not upgrade to a paid plan, their account may be suspended or downgraded automatically to the Free Plan, subject to the limitations and restrictions applicable to that plan. Any usage limits, features, or functionality will adjust based on the user’s selected or resulting plan level.
2. Early Access Nature and Limitations
2.1 Development Status
The FairyMail Early Access Program provides users with access to a pre-release version of the FairyMail platform, which is still under active development. As such, users acknowledge and agree that the Service may contain bugs, defects, errors, or other issues that could affect functionality or performance.
2.2 No Performance or Availability Guarantee
FairyMail does not guarantee the performance, reliability, uptime, or availability of any part of the Service during the Early Access period. The Service may be interrupted, modified, or temporarily unavailable without prior notice.
2.3 Limitation of Responsibility
By participating in the Early Access Program, users expressly agree that FairyMail shall not be held liable for any direct or indirect financial loss, data loss, reputational damage, or other harm resulting from the use of the Service, including issues affecting email campaign delivery, analytics, or automations.
2.4 Acknowledgment of Risk
By purchasing or activating an Early Access plan, users understand that they are participating in a testing and feedback phase. Users accept all risks associated with the use of the Service in its developmental state and agree that such participation is at their own discretion and responsibility.
3. Features and Updates
3.1 Feature Availability
The features and functionalities made available under the FairyMail Early Access Program may differ from those of the final public release and available paid plans. Certain tools, integrations, or options may be incomplete, unavailable, or subject to change without notice.
3.2 Updates and Improvements
FairyMail may, at its sole discretion, add, modify, or remove features or functionalities at any time during the Early Access period. Updates may include bug fixes, interface changes, performance improvements, or the introduction of new features.
3.3 Upgrade Limitations
Early Access users understand that not all new features or improvements released during the Early Access period will be automatically included in their current plan. FairyMail reserves the right to determine which updates apply to the Early Access version and when such updates will become available.
3.4 Final Release Differences
The final, publicly released version of FairyMail may differ substantially from the Early Access version. Participation in Early Access does not guarantee access to any specific feature, functionality, or future product version.
4. Fees and Payment Terms
4.1 Payment Requirement
Participation in the Early Access Program requires payment of the applicable subscription fee as stated on the FairyMail website or official offer at the time of purchase. Fees must be paid in full and up front prior to activation of the Early Access plan.
4.2 Billing Cycle and Duration
Each Early Access plan is valid for one (1) year beginning on the date payment is successfully processed (the “Activation Date”). At the end of this one year, the plan will automatically terminate unless the user upgrades to one of FairyMail’s subscription plans then available.
4.3 Non-Refundable Payments
All Early Access fees are non-refundable, regardless of usage, account activity, or early cancellation. Users acknowledge that the Program provides discounted access to pre-release software and services, which may be subject to technical issues, feature limitations, or changes.
4.4 Taxes and Currency
All fees are exclusive of applicable taxes, which may be added and charged based on the user’s billing address. Payments must be made in the currency stated at checkout, and any currency conversion or transaction fees are the responsibility of the user.
4.5 Pricing Changes
FairyMail reserves the right to modify or discontinue the Early Access pricing or structure at any time for new customers. Such changes will not affect users who have already activated and paid for an existing one-year Early Access plan.
4.6 Payment Processor
Payments are securely processed through approved third-party payment providers. By completing a purchase, users agree to comply with the terms and policies of such payment processors in addition to this Policy.
5. Data and Privacy
5.1 Privacy Policy Reference
All personal data collected, processed, or stored during participation in the Early Access Program is handled in accordance with the FairyMail Privacy Policy. Users are encouraged to review that document to understand how FairyMail collects and protects personal information.
5.2. Usage and Diagnostic Data
By participating in the Early Access Program, users acknowledge and consent to FairyMail collecting and processing usage data, performance metrics, and diagnostic information to help identify issues, improve service performance, and enhance user experience.
5.3 Feedback and Communications
FairyMail may also process any feedback, suggestions, or communications provided by Early Access participants to improve the Service. Such feedback may be stored and analyzed internally, but will not include personally identifiable information unless voluntarily provided by the user.
5.4 Data Protection Rights
Participants retain all rights granted under applicable data protection laws, including access, correction, and deletion rights, as detailed in FairyMail’s Privacy Policy.
6. Feedback and Communication
6.1 Voluntary Feedback
FairyMail encourages Early Access participants to share feedback, suggestions, and ideas to help improve the Service. Providing feedback is voluntary and not a condition of participation in the Program.
6.2 Rights to Use Feedback
By submitting feedback, comments, bug reports, or suggestions, users grant FairyMail a perpetual, worldwide, royalty-free, and irrevocable license to use, reproduce, modify, and incorporate such feedback into the Service or related products without compensation or acknowledgment.
6.3 Communication Channels
Participants may communicate with FairyMail through designated channels such as support email, contact forms, or other communication tools provided by the company. FairyMail may also reach out to participants to request clarification, additional input, or participation in surveys related to the Program.
6.4 Confidentiality of Discussions
Unless otherwise stated in writing by FairyMail, communications between FairyMail and participants regarding unreleased features or testing activities are considered confidential and should not be shared publicly, posted online, or disclosed to third parties.
7. Termination of Access
7.1 Termination by FairyMail
FairyMail reserves the right, at its sole discretion, to suspend or terminate a user’s participation in the Early Access Program at any time and without prior notice if:
the user violates this Policy, the Terms of Service, or any applicable laws;
the user engages in misuse, abuse, or unauthorized access of the Service; or
continued participation poses a risk to FairyMail’s systems, security, or other users.
In such cases, FairyMail may immediately restrict access to the user’s account and data.
7.2 Termination by the User
Participants may discontinue use of the Early Access Program at any time by canceling their subscription or contacting FairyMail support. No refunds or credits will be provided for early cancellation, as described in Section 4 (Fees and Payment Terms).
7.3 Effect of Termination
Upon termination, suspension, or expiration of the Early Access period:
The user’s right to access and use the Service will immediately cease; FairyMail may, but is not obligated to, retain data and account information for a reasonable period in accordance with its Privacy Policy; and the user may be offered the option to migrate to another available FairyMail plan, subject to the features and fees of that plan.
7.4 Survival of Terms
Any provisions of this Policy which, by their nature, should survive termination, including but not limited to sections regarding Liability, Data and Privacy, and Feedback and Communication, shall remain in effect following the termination of access.
8. Transition After Early Access Ends
8.1 End of Early Access Period
At the conclusion of the one-year Early Access period, or upon the official end of the FairyMail Early Access Program (whichever occurs first), users will be notified and provided with information regarding the available Standard, Pro, or Custom subscription plans.
8.2 Upgrade or Renewal Options
Users may choose to upgrade to any of the available paid plans in order to maintain uninterrupted access to their account, subscriber lists, and campaign data. Upgrading will be subject to the features, pricing, and terms applicable to the selected plan at that time.
8.3 Downgrade or Free Plan Transition
If a user does not select a new paid plan following the end of their Early Access term, their account may be automatically downgraded to the Free Plan. In such cases, usage limits, available features, and storage capacity will be adjusted in accordance with the Free Plan’s restrictions.
8.4 Account Suspension and Data Retention
FairyMail may temporarily suspend access to accounts that remain inactive or unpaid after the Early Access period ends. Data associated with such accounts may be retained for a reasonable period in accordance with the FairyMail Privacy Policy and may be permanently deleted thereafter.
8.5 No Automatic Renewal After Active Early Access Plan Period Ends
Early Access plans do not automatically renew. Continued use of FairyMail after the Early Access period requires the user to select and activate a new subscription plan.
9. Liability and Disclaimer of Warranties
9.1 No Warranties
The FairyMail Early Access Program and all related services are provided on an “as is” and “as available” basis. FairyMail makes no representations or warranties, express or implied, regarding the operation, reliability, or suitability of the Service.
To the maximum extent permitted by law, FairyMail expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be error-free or uninterrupted.
9.2 Limitation of Liability
To the fullest extent permitted by applicable law, FairyMail and its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business interruption, or goodwill arising out of or related to participation in the Early Access Program, even if FairyMail has been advised of the possibility of such damages.
9.3 Total Aggregate Liability
In no event shall FairyMail’s total aggregate liability arising out of or related to the Early Access Program exceed the total amount paid by the user for participation in the Program.
9.4 User Responsibility
Users acknowledge that they are solely responsible for their use of the Service, including any email campaigns, content distribution, or marketing activities conducted through FairyMail.
Users must ensure that all activity complies with applicable laws and regulations, including data protection, anti-spam, and intellectual property laws, as well as FairyMail’s Terms of Service, Privacy Policy, Data Processing Agreement (DPA), and Anti-Spam Policy.
Users assume full responsibility for the legality, accuracy, and compliance of their communications, subscriber data, and campaigns, and agree that FairyMail bears no responsibility for violations arising from user-generated content or improper use of the Service.
9.5 Jurisdictional Limitations
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such cases, the exclusions and limitations outlined in this section shall apply to the greatest extent permitted by law.
10. Changes to This Policy
10.1 Right to Modify
FairyMail reserves the right to amend, update, or replace this Early Access Policy at any time. Updates may reflect changes in the Program, new features, technical improvements, or adjustments to comply with legal or regulatory requirements.
10.2 Notice of Changes
FairyMail will post any revised version of this Policy on its official website, indicating the date of the most recent update. In cases of material changes that significantly affect participants’ rights or obligations, FairyMail will provide additional notice by email or through the Service interface.
10.3 Continued Participation
Continued participation in the Early Access Program after the effective date of any update constitutes acceptance of the revised Policy. Users who do not agree to the updated terms should discontinue use of the Program immediately.
